Terms of service
Welcome to Shana Kay’s Elegant Events's terms of service! By using our services, you agree to the following terms and conditions:
1. Booking & Payment
• A non-refundable 50% deposit is required at the time of booking to secure your event date.
• The remaining balance is due no later than 30 days prior to the event date unless otherwise agreed in writing.
• Services will not be rendered unless payment terms are met in full.
2. Non-Refundable Deposit
• All deposits are non-refundable under any circumstances, including event cancellation, rescheduling, or change of plans by the client.
• The deposit secures your date and reserves staff, time, and resources.
3. Cancellations & Rescheduling
• Client-initiated cancellations result in forfeiture of the deposit.
• Rescheduling is subject to availability and must be requested in writing.
• If rescheduling is approved, the deposit may be applied to a new date within 4 months, at the Company’s discretion.
4. Scope of Services
• Services provided will be limited to those outlined in the agreed proposal, invoice, or contract.
• Any additional services requested outside the agreed scope may incur additional fees and must be approved in writing.
5. Client Responsibilities
• The client is responsible for providing accurate event details, timelines, venue access, and vendor information.
• The Company is not responsible for delays or issues caused by incomplete, inaccurate, or late information provided by the client or third-party vendors.
• Friends/family members are kindly asked not to participate in setting up for the event, picking up, dropping off items, or preparing any food. We have a team of professionals who are trained and experienced in creating a seamless and well-executed event. By having our trained professionals handle this aspect, this ensures your event runs timely, smoothly and elegantly. (this only applies to full service events)
6. Event Day Conditions
• Shana Kay’s Elegant Events is not responsible for circumstances beyond its control, including but not limited to weather, venue restrictions, vendor failures, or acts of God.
• The Company reserves the right to refuse or discontinue services in unsafe, hostile, or inappropriate environments.
7. Damage & Liability
• The client is responsible for any damage to Company-owned décor, equipment, or rentals caused by guests, vendors, or venue staff.
• The Company’s liability is limited to the amount paid for services rendered.
• Clients must obtain any necessary permits or permissions for their event. We are not responsible for delays or issues due to missing permits.
8. Photography & Marketing
• The Company reserves the right to use photos or videos of event décor, setups, or designs for marketing and promotional purposes unless the client submits a written request to opt out prior to the event.
9. Force Majeure
• The Company shall not be held liable for failure to perform services due to circumstances beyond reasonable control, including natural disasters and government restrictions.
10. Governing Law
• These Terms of Service shall be governed by and interpreted in accordance with the laws of the NY, CT, MA and RI
11. Agreement
• By submitting a deposit or payment, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
